7월 20일, 태국 사뭇쁘라깐 지방법원은 태국 최초로 공개적으로 양심적 병역거부를 선언하고 재판을 받는 네티윗 초티팟파이살(Netiwit Chotiphatphaisal) 사건의 판결을 선고한다. 만약 1954년 제정된 병역법에 따라 유죄가 인정될 경우 그는 최대 3년의 징역형을 받을 수 있다. 네티윗은 민주화운동가이자 인권운동 활동가 그리고 출판인이자 조직가로서, 고등학생 시절부터 사회운동을 시작한 그는 지난 12년 동안 자신의 입장을 유지해 왔고, 그 결과 지금 이 재판의 피고인이 되었다.
네티윗은 만 18세가 되던 생일에 병역을 수행하지 않겠다고 선언했다. 그는 숨거나 조용히 면제 방법을 찾지 않았다. 그는 매년 당국 앞에 다시 나타나 같은 입장을 밝혔다. 2024년 4월 5일, 그는 사뭇쁘라깐의 방푸 지역의 병무청에서 병역거부 선언문을 낭독하며, 모든 태국 시민은 군 복무 여부를 스스로 선택할 동등한 자유를 가져야 하고 누구도 강제로 복무를 강요받아서는 안 된다고 말하며 “개인에게도 국가에도 도움이 되지 않는다”고 밝혔다. 선언문을 낭독한 뒤 그는 징병 추첨 참여를 거부했다. 그는 병역법 제45조 위반 혐의로 기소되었다.
재판 과정에서 네티윗 측 변호인은 헌법재판소에 병역법의 위헌 여부를 판단해 달라고 요청했고, 이는 양심적 병역거부가 이러한 방식으로 다뤄진 최초의 시도였다. 2026년 5월 12일 태국 헌법재판소는 병역법이 헌법이 보장하는 자유와 종교의 자유를 침해하지 않는다고 만장일치로 결정했다. 이에 따라 형사재판은 다시 진행되었고, 오는 7월 20일 판결을 앞두고 있다.
개혁이 시급한 이유
태국은 자원입대를 허용하고 있으며, 정부도 먼저 이러한 인원으로 병력을 충당하지만, 지금까지 자원입대로는 매년 필요한 인원을 채우지 못했으며 부족한 인원은 매년 4월 추첨을 통해 선발한다. 붉은 카드를 뽑으면 2년 동안 군 복무를 해야 하고, 검은 카드를 뽑으면 복무가 면제된다. 이 시스템은 표면상으로는 자발적 선택처럼 보일 수 있지만 구조적으로는 강제적이며, 자신의 양심에 따라 병역을 거부하는 사람들에게는 어떠한 법적 선택지도 마련되어 있지 않다. 국제앰네스티, 태국인권변호사협회(Thai Lawyers for Human Rights),전쟁저항자인터내셔널(War Resisters’ International)은 모두 태국 정부에 시민적 및 정치적 권리에 관한 국제규약(ICCPR) 제18조에 따라 이 공백을 메울 것을 촉구해왔다. 해당 조항은 양심적 병역 거부를 사상, 양심 및 종교의 자유에 따라 보호받아야 한다고 보고 있다.
왜 이 사건이 중요한가
이 사건은 한 개인에 대한 형사처벌을 넘어, 더 광범위한 법적, 정치적 결과를 가져올 수 있다. 태국에서 깊이 간직한 도덕적, 종교적 또는 철학적 신념에 따라 병역을 거부하는, 양심적 병역거부를 중심으로 다루는 첫 형사재판으로 간주되고 있다. 많은 나라들은 병역거부를 인정하고 대체복무 제도를 제공하고 있지만, 태국은 아직 어느 쪽도 인정하지 않고 있다. 인권단체들은 이러한 지점들이 사상과 양심, 종교의 자유를 보장하는 ICCPR 제18조 하의 국제 표준에 어긋난다고 지적해 왔다.
네티윗이 유죄 판결을 받으면 최대 3년의 징역형을 선고받을 수 있다. 이번 재판은 헌법재판소가 기존 병역법을 유지하는 결정을 내렸음에도 불구하고, 태국 법원이 양심의 자유에 관한 국제인권의 원칙을 준수할 의향이 있는지를 보여주는 시험이 될 것이다.
우리는 7월 20일 판결을 앞두고 태국 정부에 다음과 같이 요구한다
- 네티윗 초티팟파이살에 대한 모든 혐의를 취하하라.
- 시민적 및 정치적 권리에 관한 국제규약(ICCPR) 제18조에 따라 양심적 병역거부권을 법적으로 인정하라.
결과가 어떻게 나오든, 7월 20일의 판결은 태국의 군사 개혁, 강제 징집 및 양심의 자유에 대한 향후 논쟁에서 중요한 기준점이 될 것이다.

Thailand: Court to rule in first criminal case on conscientious objection
On July 20, the Samut Prakan District Court will deliver its verdict in the case of Netiwit Chotiphatphaisal, Thailand's first publicly declared conscientious objector to stand trial for refusing military conscription. If convicted under the 1954 Military Service Act, he will face up to three years in prison. Netiwit is a democracy and human rights activist, publisher, and organiser whose activism began in high school and who has publicly maintained this position for twelve years, culminating in this criminal trial.
On his eighteenth birthday, Netiwit declared he would not participate in military conscription. He did not disappear or seek quiet exemption. Every year, he reappeared before the authorities to say the same thing. On April 5, 2024, he went to the conscription centre in Samut Prakan’s Bang Pu district and read a manifesto of refusal, stating that all Thai citizens should have equal freedom to choose whether to serve, and that no one should be coerced into it, “as it is not beneficial to individuals or the nation.” He then declined to enter the lottery. He was charged
under Section 45 of the Military Service Act.
During the trial, Netiwit’s lawyer asked the court to refer the question of whether the Military Service Act is constitutional or not to the Constitutional Court, marking the first time conscientious objection had been argued in this way. On May 12, 2026, the Constitutional Court ruled unanimously that the Act's provisions do not violate constitutional protections of liberty and religious freedom. The criminal case resumed on that basis, and the verdict now falls on July 20.
Why reform is overdue
Thai law permits voluntary enlistment, and the state relies on it first, but volunteers have never filled the annual quota, so every April the shortfall is made up through a lottery: red card for two years' service, black for exemption. The system is structurally compulsory even where it appears voluntary, and it offers no legal path for those who object on conscience, a gap Amnesty International, Thai Lawyers for Human Rights, and War Resisters’ International have all called on Thailand to close, in line with Article 18 of the ICCPR, which recognises conscientious objection as protected under freedom of thought, conscience, and religion.
Why the case matters
Beyond the individual prosecution, the case could have broader legal and political consequences. It is widely regarded as the first Thai criminal case centred on conscientious objection, the refusal to perform military service based on deeply held moral, religious, or philosophical convictions. While many countries recognise conscientious objection and provide alternative civilian service, Thai law currently does neither. Human rights organisations argue that this places Thailand at odds with international standards under Article 18 of the International Covenant on Civil and Political Rights (ICCPR), which protects freedom of thought, conscience, and religion.
If convicted, Netiwit faces up to three years' imprisonment. The hearing is also expected to test whether Thai courts are willing to engage with international human rights principles on freedom of conscience, despite the Constitutional Court's earlier decision to uphold the existing conscription law.
Ahead of the July 20 verdict, we call on the Thai authorities to:
- Drop all charges against Netiwit Chotiphatphaisal.
- Legally recognise the right to conscientious objection, in line with Article 18 of the International Covenant on Civil and Political Rights (ICCPR).
- Establish a genuine, non-punitive alternative civilian service for conscientious objectors.
Whatever the outcome, the verdict on July 20 will become a significant reference point in future debates over military reform, compulsory conscription and freedom of conscience in Thailand.
