우리는 병역을 거부한 양심적 병역거부자 네티윗 초티팟파이살(Netiwit Chotiphatphaisal)에게 유죄 판결을 내린 사뭇쁘라칸 지방법원의 결정에 깊은 유감을 표한다.  7월 20일 판결에서, 법원은 징역 6월에 집행유예 1년을 선고했다. 이 유죄판결은 태국이 당사국인 시민적 및 정치적 권리에 관한 국제규약(ICCPR) 제 18조에 따라 보호되는 사상, 양심 및 종교의 자유에 대한 권리를 심각하게 침해하고 있음을 보여준다.

네티윗의 사례는 태국에서 양심적 병역거부에 관한 형사 기소가 이루어진 첫 번째 사건이다. 그는 10년 이상 일관적이고 공개적으로 양심에 기반하여 병역에 참여할 것을 거부해왔다. 태국 정부는 이러한 권리를 인정하고 보호하기보다는, 평화적인 행동을 범죄화하는 것을 선택했다. 

이 판결은 태국이 국제 인권 기준에 맞는 법을 만들 기회를 놓친 것이다. 양심적 병역거부는 사상, 양심 및 종교의 자유에 내재된 인권이다. 그 누구도 그 자신의 깊은 신념을 이유로 병역에 참여 할 것을 거부함으로써 형사 처벌을 받아서는 안된다.

우리는 네티윗 초티팟파이살과 전쟁과 군 복무에 참여하기를 거부하는 모든 이들과 연대한다. 우리는 태국 당국이 법적으로도 실질적으로도 양심적 병역거부권을 인정하고, 양심적 병역거부의 범죄화를 종식하고, 누구라도 자신의 양심을 평화롭게 실천했다는 이유로 처벌받지 않을 권리를 보장할 것을 다시 한번 촉구한다.

Statement on the conviction of Thai conscientious objector Netiwit Chotiphatphaisal

We are deeply disappointed by the decision of the Samut Prakan District Court to find conscientious objector Netiwit Chotiphatphaisal guilty for refusing military conscription. In its decision of 20 July, the court imposed a six-month prison sentence suspended for one year. The conviction represents a serious violation of the right to freedom of thought, conscience, and religion, protected under Article 18 of the International Covenant on Civil and Political Rights (ICCPR) to which Thailand is a party.

Netiwit’s case is the first criminal prosecution in Thailand centred on conscientious objection to military service. For more than a decade, he has consistently and publicly maintained his refusal to participate in military service on grounds of conscience. Rather than recognising and protecting this right, the Thai authorities have chosen to criminalise its peaceful exercise.

This judgment is a missed opportunity for Thailand to bring its laws into line with international human rights standards. Conscientious objection to military service is a human right inherent in the right to freedom of thought, conscience, and religion. No one should face criminal sanctions for refusing to participate in military service because of their deeply held beliefs.

We stand in solidarity with Netiwit Chotiphatphaisal and all those who refuse participation in war and military service. We reiterate our call on the Thai authorities to recognise the right to conscientious objection in law and practice, to end the criminalisation of conscientious objectors, and to ensure that no one is punished for the peaceful exercise of their conscience.
